Terms of Electronic Service

§ 1. General provisions
These Terms set out the rules for providing services by electronic means on the Wokanda website (the "Service"), available at wokanda.app. The Service is operated by the entity identified in the Service footer (the "Operator").
Use of the Service requires acceptance of these Terms and the Privacy Policy.
§ 2. Definitions
- User - a natural person practising as an attorney (adwokat), legal advisor (radca prawny), attorney trainee or legal-advisor trainee, holding a current entry in the KRAIA or KIRP register.
- Client - a User publishing a request for procedural substitution.
- Performer - a User submitting an offer to carry out a request.
- Request - a posting by a Client describing a procedural-substitution need (hearing, closed session, procedural task, file inspection, etc.).
- Account - an individual set of Service resources assigned to a User after successful verification.
§ 3. Conditions of service
The Service is provided exclusively to individuals practising the legal professions listed in § 2. Registration requires accurate identification data and the registration number in the relevant chamber. The Operator verifies a User's professional status in the public KRAIA or KIRP register; successful verification is a condition for using the Service's transactional features.
Technical requirements: a current web browser with JavaScript enabled and an active email account.
§ 4. Requests and responses
The Client publishes a Request containing the type of task, location, date, budget and required professional status of the Performer. The Performer submits an offer with a proposed rate and an optional comment. After mutual confirmation, a private chat opens between the parties.
The parties conclude their agreement directly between themselves; the Operator solely provides a matching platform and is not a party to the engagement.
§ 5. User obligations
- providing accurate and up-to-date information;
- not including in Requests or messages any personal data of clients or information covered by professional secrecy;
- treating other Users with due respect and in accordance with professional ethics;
- not submitting sham, spam or misleading offers or Requests.
§ 6. Abuse reports and moderation
A User may report another User or a specific Request violating these Terms (the "Report" button on the profile and Request card). The Operator's moderator reviews reports and may take actions including account blocking, removal of a Request or a warning. In disputes concerning a completed substitution, a User may open an inquiry from the Request details view.
§ 7. Liability
The Operator endeavours to keep the Service continuously available but does not guarantee uninterrupted availability and may introduce technical breaks. The Operator is not liable for improper performance of a Request by the Performer or for the quality of cooperation between Users.
§ 8. Withdrawal and account deletion
A User may delete the Account at any time from "Profile" → "My data". Deletion results in anonymisation of personal data while preserving historical links to completed Requests (in accordance with Art. 17 GDPR and the Operator's legitimate interests).
§ 9. Changes to the Terms
The Operator may amend these Terms, notifying Users 14 days in advance at the email address associated with the Account. Non-acceptance of changes entitles the User to delete the Account before the changes take effect.
§ 10. Final provisions
Matters not governed by these Terms are subject to Polish law. Disputes arising from use of the Service are heard by the court with territorial jurisdiction over the Operator's registered office.
